Website Update & Content Policy
Ismarts will not publish any content without a written email from the client, or if any uncertain elements exist. For example, if the Web Content Author suspects that the information intended for a web page may not be accurate, the information should not be published. All questionable information should be resolved by the Web Content Author and confirmed with the Client and Ismarts Manager so that it is complete and accurate prior to publishing.
Our Update/Content Authors must check that all links work and that all content is accurate when pages are made live or updated. An email will be sent to the Client-Contact/Content Manager regarding the Design and Structure change whenever a page is edited. The email contains a BETA-link to the page and the name of Web Content Author.
We require clear written instructions for all updates sent to us (updates@ismarts.com) Depending on the volume and complexity of the update(s) Ismarts will make every effort to post updates ASAP. Following are guidelines for our managed-hosting updates:
- We require a URL link and clear instructions to the page(s) for update.
- For NEWS updates: We require the exact title of the release. Exact time for the posting of the news-release. All news releases converted into PDF file.
(We DO NOT edit or change news releases!! Updated within 1-3 hours)
- All presentations converted into PDF (uploaded into designated File Exchange FTP account)
- Any major updates requiring changes to page structure, links,/navigation or graphics (Approx. 3 business day)
Ismarts will use only the page structure, styles and formatting that have been set by the original Design & Structure. Any changes to the original structure will be billed accordingly. For instance, if a table has been set on a page with a particular style of font or background colour, the Web Content Author must use the same styles if making any additions to the table. Similarly, no new coloured text, font styles or sizes are to be introduced unless requested by client and a quote is agreed upon.
If a new type of content that currently does not exist on a page needs to be introduced such as a table of data, the Sub-Site Manager for Design & Structure must be contacted. The correct format for such content will then be provided and billed accordingly as these changes are NOT included in the managed-hosting packages content updates.
The Web Content Author must not create any new pages or sections without prior permission from the Sub-Site Manager for Design & Structure. If a new page or section is required. The Sub-Site Manager for Design & Structure must be contacted as this is a structural change.
Account transfers, hosting & design policy
All of our accounts related site code, script(s) such as PHP, ASP, SQL, PERL or other server-side script(s) are maintained and hosted by ISMARTS.com on our servers only. Unless noted otherwise. This improves uptimes, security and speed of your site.
ISMARTS does not provide FTP, SQL access or any other server access to any third party source for security reasons.
All account terminations are without refund. We do not refund any outstanding balances related to hosting.
All dynamic scripting and funcionalities of our site designs are part of the account's monthly hosting fee. In the case of an account termination or transfer we provide straight HTML code as is with images only in a ZIP file. (.gif, .jpg, .PDF) All other source code, SQL or server-side scripts, FLASH scripts or .FLAs are retained by ISMARTS.
All our designs, programming and tech-support is available on an hourly rate basis.

Acceptable Use Policy
Customer shall not do any of the following:
i. restrict or inhibit any other
user from using and enjoying the Service and/or the Internet; or
ii. upload, post, publish,
transmit, reproduce, distribute, or participate in the transfer or sale,
or in any way exploit any information, software or other material
obtained through the Internet which is PROTECTED BY COPYRIGHT or other
proprietary rights or derivative works with respect thereto, without
obtaining permission of the copyright owner or right holder; or
iii. use the SMTP services of a
third party for the purposes of relaying or sending electronic mail
messages without the express permission of that third party; or
iv. host a publicly-accessible
"open relay" SMTP or anonymous remailer service for any
purpose, cause, or reason; or
v. post a commercial advertisement
to any USENET newsgroup, Internet "chat room", bulletin board,
or similar forum, if the target forum is not specifically chartered for
public advertisement by non-private parties of items "for
sale" or
vi. post to any USENET Newsgroup or
other newsgroups, forum, email mailing list or similar group or list
articles which are off-topic according to the charter or other public
statement of the group; or
vii. send Unsolicited Commercial E-mail (UCE, also known as SPAM)
to any number of e-mail users or lists; or
viii. maintain, or send e-mail to,
"opt-in targeted marketing lists" if the Customer cannot
demonstrate, to ISMARTS.COM's satisfaction, that the members of the
list(s) have knowingly requested to be added to the list(s) in question
through direct action of their own doing, and that easily-accessible,
automated opt-out/removal mechanisms are in place and available to the
members of the list(s); or
ix. engage in any activity that is,
or appears to be, an attempt to gain unauthorized access to a remote
system or network, or to gain information that could later be used to
assist in gaining unauthorized access to a remote system or network,
such as port scanning, dictionary attacks, Denial of Service attacks,
server/service hijacking, etc.; or
x. engage in any of the foregoing
activities using the service of another provider, but channeling such
activities through an ISMARTS.COM account or remailer, or using an
ISMARTS.COM account as a mail drop for responses to UCE, or hosting a
website that is advertised via UCE that originates from a non-ISMARTS.COM -connected
source, or otherwise requiring return transit through ISMARTS.COM's
internet backbone; or
xi. falsify or "spoof"
user information provided to ISMARTS.COM or to other users of the
Service, and for handling all complaints and trouble reports made by its
own customers and authorized users; or
xii. use the Service in violation or
contravention of the Communications Act of 1934, as amended by the
Telecommunications Act of 1996, or any other applicable law, regulation,
order or other governmental directive, or abuse or fraudulently use the
Service in any way not specifically set forth above.
If the customer violates our Terms of
Service it will result in termination of all services without refund. |
